Identify this plant don't know if its a flower or a weed.

It looks like a heavily stressed sunflower.

Really a just thought it was a weed but the mrs's thinks its definitely a flower but never planted it ‍.

I get them all over because of the bird seed we put out.

Yes, I often get volunteer Black Oil Sunflowers (Helianthus annuus) planted by jays or rodents. I often leave them be. Sometimes they will grow well, depending on location.

Sunflowers have deep root systems, they do much better in the ground than in a pot, probably why it looks so stressed. They don't need much, just some soil to sink their roots down into and lots and lots of sun.
